Terms of Service

1. Acceptance of Terms

By accessing or using OpenClaw ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including browsers, customers, and creators who list agents on the marketplace.

2. Services

OpenClaw provides an AI agent marketplace where users can browse, deploy, build, and purchase AI agents. We offer three primary products:

• Marketplace agents (ready-made, subscription-based)
• Self-built agents (created through our wizard, subscription-based)
• Expert Build (custom agents built by our team, one-time + hosting fees)

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access.

4. Payments & Billing

Subscription fees are billed monthly or annually as selected. All payments are processed through Stripe. Refunds are available within 7 days of initial purchase. Expert Build deposits are non-refundable once work begins. We reserve the right to change pricing with 30 days notice.

5. Intellectual Property

Agents you create through our platform remain your intellectual property. By listing an agent on the marketplace, you grant OpenClaw a non-exclusive license to distribute and market your agent. OpenClaw retains all rights to the platform, tools, and infrastructure used to build and run agents.

6. Limitation of Liability

OpenClaw is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

7. Termination

We may terminate or suspend your account at any time for violation of these terms. You may cancel your account at any time through your dashboard. Upon termination, your agents will be deactivated and data retained for 30 days before deletion.

8. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days in advance. Continued use of the Service after changes constitutes acceptance of the new terms.
